1. Acceptance of Terms

By using Sergei's Agent, you agree to these Terms of Service. If you do not agree, do not use Sergei's Agent.

Sergei's Agent is a personal email search tool designed for individual, non-commercial use.

2. Description of Service

Sergei's Agent provides:

• Local synchronization of Gmail emails to your infrastructure
• Hybrid search capabilities (keyword + semantic)
• Email monitoring and notification features
• Integration with AI assistants via Model Context Protocol (MCP)

Important: Sergei's Agent is self-hosted. You are responsible for:

• Providing and maintaining your own infrastructure
• Securing your server or computer
• Backing up your data
• Compliance with applicable laws in your jurisdiction

3. User Responsibilities

You agree to:

• Lawful use: Use Sergei's Agent only for lawful purposes
• Personal use: Use Sergei's Agent for your own email only, not others'
• Security: Protect your OAuth credentials and infrastructure
• Compliance: Comply with Google's Terms of Service and Gmail API policies
• Backups: Maintain backups of important data

You agree NOT to:

• Use Sergei's Agent to access emails you don't own or aren't authorized to access
• Circumvent rate limits or abuse the Gmail API
• Use Sergei's Agent for commercial purposes without proper licensing
• Modify Sergei's Agent to violate Google's policies or applicable laws

4. OAuth and Gmail API

Sergei's Agent uses Google's Gmail API. By authorizing Sergei's Agent:

• You grant Sergei's Agent permission to access your Gmail data as specified
• You agree to Google's Terms of Service: https://policies.google.com/terms
• You can revoke access at any time via your Google Account settings

Scope of Access:

• gmail.readonly - Read email content
• gmail.modify - Modify labels (e.g., mark as read)

5. Data Ownership

Your Data: You retain full ownership of your email data. Sergei's Agent does not claim any rights to your data.

Local Storage: Since email data is stored on your infrastructure, you have complete control and are solely responsible for:

• Data security and access control
• Data backup and recovery
• Data retention and deletion
• Compliance with data protection laws (GDPR, CCPA, etc.)

6. Disclaimer of Warranties

Sergei's Agent is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

You use Sergei's Agent at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, Sergei's Agent and its creators shall not be liable for any:

• Direct, indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Service interruptions or failures
• Security breaches on your infrastructure
• Unauthorized access to your data
• Errors or bugs in the software

Maximum liability: Since Sergei's Agent is provided free of charge, our maximum liability is limited to $0.

8. Indemnification

You agree to indemnify and hold harmless Sergei's Agent and its creators from any claims, damages, or expenses arising from:

• Your use or misuse of Sergei's Agent
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

9. Service Availability

No Guarantee: Sergei's Agent is a personal project with no guaranteed uptime, availability, or support.

The OAuth authorization service (AWS Lambda) may be unavailable due to:

• AWS service outages
• Maintenance or updates
• Infrastructure failures

Recommendation: Maintain local backups of OAuth credentials and email data.

10. Updates and Modifications

Sergei's Agent is open-source software. Updates may:

• Add new features or remove existing ones
• Fix bugs or security vulnerabilities
• Change how data is stored or processed
• Require re-authorization or reconfiguration

You are responsible for:

• Reviewing updates before applying them
• Testing updates in a safe environment
• Backing up data before updates

11. Third-Party Services

Sergei's Agent integrates with third-party services:

• Google Gmail API: Subject to Google's Terms of Service
• AWS (Optional): Subject to AWS Customer Agreement

You are responsible for complying with the terms of these third-party services.

12. Termination

You may stop using Sergei's Agent at any time by:

• Revoking OAuth access in your Google Account
• Deleting the application and its data
• Removing AWS resources if deployed

We may terminate the OAuth authorization service at any time for any reason, including:

• Violation of these Terms
• Abuse of the Gmail API
• Technical or security reasons

13. Open Source License

Sergei's Agent is open-source software. The source code is subject to its license terms (typically MIT or similar permissive license).

You may:

• Use the software for personal or commercial purposes
• Modify the code to suit your needs
• Distribute copies or modifications (subject to license)

Attribution: If required by the license, you must maintain attribution and copyright notices.

14. Intellectual Property

Your Content: You retain all rights to your email data.

Sergei's Agent Code: Subject to the open-source license.

Trademarks: "Gmail" and "Google" are trademarks of Google LLC. Sergei's Agent is not affiliated with or endorsed by Google.

15. Governing Law

These Terms shall be governed by the laws of your jurisdiction. Since Sergei's Agent is a personal tool, you are responsible for ensuring compliance with local laws.

16. Changes to Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last Updated" date at the top of this page.

Your continued use of Sergei's Agent after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
